Durham Regional Police officers conduct compliance checks on Dundas St E, Brock St N, and Taunton Rd for O. Reg 369/09 adherence. The Waterfront Trail through Whitby Harbour and Port Whitby Marina are priority patrol zones, particularly in summer when pedestrian and cyclist volumes are highest.
Common violations in the Pringle Creek and Whitby Shores areas include e-bikes exceeding the 32 km/h speed limit, missing the required bilingual compliance label, and riders under 16 without helmets. Officers also enforce at Whitby GO Station cycling facilities where e-bikes are used daily for transit connections.
Enforcement activity at the Whitby Marina increases from May through September. Dealers along Brock St and near the Whitby Town Centre report strong demand for compliance labels as local ridership grows.
Local note: Whitby Harbour and Port Whitby Marina are actively patrolled during summer. Durham Regional Police enforce Ontario HTA requirements at all marina access points and along the Waterfront Trail from the Ajax boundary to Oshawa.

An e-bike without a valid bilingual compliance label is not classified as a "power-assisted bicycle" under Ontario law — it defaults to classification as a motor vehicle. This means the rider requires a valid driver's licence, vehicle registration, and insurance.

- ✓Rider is 16 years of age or older
- ✓Approved bicycle or motorcycle helmet worn
