Why Imported E-Bikes Lack the Label

Imported e-bikes often arrive in Ontario without the bilingual compliance label required under Ontario Regulation 369/09, which governs the sale and use of power-assisted bicycles (PABs). This regulation mandates that all PABs sold in the province must be clearly marked with a bilingual (English and French) label indicating compliance. The absence of this label on many imported units is primarily due to differences in regulatory requirements between manufacturing countries and Canada. Overseas manufacturers produce e-bikes for the domestic market or for international markets with varying or less stringent labelling laws, and as a result, the Ontario-specific bilingual compliance label is not included as part of standard manufacturing or export practices.

Importer Obligations

For importers, it is essential to understand that the responsibility for compliance lies with the person bringing the product into the province. Under Regulation 369/09, importers must ensure that each PAB is affixed with a durable, legible, and bilingual label before it is offered for sale. This label must be permanently attached to the frame or another prominent part of the e-bike.

Importers should take proactive steps to ensure compliance. This includes sourcing or producing a durable, weather-resistant label that meets the size, placement, and language requirements of the regulation. The label must be applied before the e-bike is delivered to the dealer or made available for sale. Importers are advised to maintain records of label application and compliance verification to demonstrate due diligence in the event of an inspection.

English (required):

“This power-assisted bicycle complies with Ontario Regulation 369/09.”

French (required — equally prominent):

“Ce vélo à assistance électrique est conforme au Règlement 369/09 de l'Ontario.”

Both languages must be equally prominent and clearly legible. The label must be permanently affixed to the frame — not tucked inside packaging, not on a hang tag, and not on a paper insert.

Dealer Responsibility for Imported Units

Retail dealers who sell non-compliant imported e-bikes may be held responsible under the Highway Traffic Act, as the regulation places the onus on the seller to ensure that the product being sold meets all applicable requirements. This includes not only the presence of the bilingual label but also confirmation that the e-bike meets the technical specifications outlined in the regulation: motor power, speed limits, and braking requirements.
