What Voids Your Classification
Ontario Regulation 369/09 defines a power-assisted bicycle based on specific technical parameters. Change any of those parameters — intentionally or through wear — and your bike may no longer qualify as a PAB. Here is exactly what each common modification does to your legal standing.
Under Ontario Regulation 369/09, e-bikes are classified and regulated based on specific technical parameters. Any modification to an e-bike that alters those parameters affects its legal classification and can expose the rider or dealer to liability under the Highway Traffic Act.
1. Speed Tuning — De-Restricting Beyond 32 km/h
Modifying an e-bike to exceed the 32 km/h speed limit changes its classification under the regulation. A PAB, which is limited to 32 km/h and provides assistance only while pedalling, becomes non-compliant once that speed restriction is removed. If the motor continues to assist beyond 32 km/h, the e-bike is reclassified as a motor vehicle, requiring a valid driver's licence, insurance, and registration.
Riders caught operating a de-restricted e-bike may face fines, impoundment, and potential charges under the HTA. Dealers who knowingly sell or modify e-bikes to exceed 32 km/h are also liable and may face enforcement action from the Ministry of Transportation.
2. Motor Swap — Replacing the 500W Motor with Higher Output
Replacing a 500W motor with a higher output motor (750W, 1000W, or greater) alters the e-bike's compliance status. Ontario law allows a maximum motor power of 500W for PAB classification. A motor exceeding this limit means the e-bike no longer qualifies as a power-assisted bicycle under the regulation.
If the modified bike is operated without a licence or registration, the rider is in violation of the HTA. Dealers who install or sell such modifications are responsible for ensuring compliance and may be held liable for any enforcement action taken against the buyer. A motor swap is not a minor upgrade — it changes the vehicle classification.
3. Compliance Label Removal — Label Falls Off or Is Physically Removed
The compliance label is a legal requirement under Regulation 369/09 and must remain affixed to the e-bike at all times. If the label is removed, damaged beyond legibility, or falls off due to weathering, the e-bike is considered non-compliant until the label is replaced.
Riders may be stopped and issued a ticket for operating a non-compliant e-bike — even if the bike itself still meets all technical specifications. The label is the officer's primary method of verifying compliance at roadside. Dealers who knowingly sell e-bikes without compliance labels, or who fail to replace them after legitimate repairs, are subject to enforcement action.
4. Throttle Addition — Adding a Twist Throttle to a Pedal-Assist-Only Bike
Adding a throttle to a pedal-assist-only e-bike changes how the motor is activated. If the added throttle allows the motor to operate without any pedalling, the bike's operating mode changes and may affect its PAB classification under the regulation, which requires that the motor only assist while the rider is pedalling.
If the throttle-equipped bike can exceed 32 km/h under throttle power alone, or if the motor activates without pedalling, the bike risks reclassification as a motor vehicle. Dealers who make such modifications without updating the compliance documentation are liable for any enforcement action that follows.
Label Replacement After Legitimate Repairs
After any legitimate repair or component replacement that does not alter the e-bike's compliance status (brake pad replacement, tire change, battery service), the original compliance label must remain in place or be reattached if disturbed. If the label is lost or damaged during service, it must be replaced before the bike is returned to the customer. A bike without a readable compliance label cannot be legally ridden on Ontario roads or trails.
